UK Employment Law Glossary: NES, NMW, ACAS, TUPE Defined
Table of Contents
UK employment law is layered — a stack of statutes, regulations, codes of practice, and case-law shorthands. This glossary defines the 40 most-used terms and acronyms an employer or HR practitioner needs to navigate it. Each entry cites the statutory anchor where applicable.
ACAS — Advisory, Conciliation and Arbitration Service. Statutory non-departmental public body; produces the ACAS Code of Practice on Disciplinary and Grievance Procedures and offers free Early Conciliation before tribunal claims. See: https://www.acas.org.uk
ACAS Code — The Code of Practice on Disciplinary and Grievance Procedures. Not law itself, but tribunals must take it into account; unreasonable failure to follow can adjust compensation by up to 25% under TULRCA 1992, s.207A.
Auto-enrolment (AE) — Compulsory pension enrolment regime under the Pensions Act 2008, Part 1. Eligible jobholders (aged 22 to State Pension age, earning above the trigger ≈ £10,000) are auto-enrolled into a qualifying pension scheme. Total minimum contribution 8% of qualifying earnings; employer minimum 3%.
CEST — Check Employment Status for Tax. HMRC’s online tool to determine employment status for tax purposes. https://www.gov.uk/guidance/check-employment-status-for-tax
CoS — Certificate of Sponsorship. Issued by a licensed sponsor (Skilled Worker route) to a sponsored worker via the Sponsor Management System.
Continuous employment — Period of employment without a break of more than 1 week. Counts towards qualifying service for unfair dismissal (2 years), redundancy pay (2 years), family leave eligibility, and statutory notice. ERA 1996, s.212.
Discretionary ground (Schedule 2 HA 1988) — A possession ground where the court orders possession only if reasonable. Cross-reference: Cell #8 (UK Lease).
DSE — Display Screen Equipment. Health & Safety (Display Screen Equipment) Regulations 1992 require workstation assessments for habitual users.
EAT — Employment Appeal Tribunal. Hears appeals from the Employment Tribunal on points of law.
EICR — Electrical Installation Condition Report. Required every 5 years in residential lettings; cross-reference Cell #8 (UK Lease).
EMI — Enterprise Management Incentive. Tax-advantaged share scheme for SMEs. https://www.gov.uk/tax-employee-share-schemes/enterprise-management-incentives-emis
Employee — Person under a contract of employment (ERA 1996, s.230(1)). Distinguished from worker and self-employed by mutuality of obligation, control, and personal service.
EoR — Employer of Record. Third-party arrangement managing cross-border employment. Used where the worker’s habitual workplace is outside the UK.
EPS — Employer Payment Summary. RTI return submitted to HMRC where no payments are made in a period.
Equality Act 2010 — Statute prohibiting discrimination on 9 protected characteristics: age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex, sexual orientation. https://www.legislation.gov.uk/ukpga/2010/15/contents
ERA 1996 — Employment Rights Act 1996. The core statute for employee/worker rights, including Section 1 statement, unfair dismissal, redundancy, time off.
ET — Employment Tribunal. First-tier judicial body for employment disputes. https://www.gov.uk/courts-tribunals/employment-tribunal
FPS — Full Payment Submission. RTI return submitted to HMRC on or before payday.
Gross misconduct — Conduct so serious it justifies summary dismissal without notice. Examples: theft, fraud, violence, gross negligence. Even gross misconduct dismissals require ACAS Code procedure.

HSE — Health and Safety Executive. Enforces the Health and Safety at Work etc. Act 1974 and subordinate regulations. https://www.hse.gov.uk
ICO — Information Commissioner’s Office. UK GDPR / Data Protection Act 2018 regulator. Employer guidance: https://ico.org.uk/for-organisations/employment-information/
IDSP — Identity Service Provider. Certified third party providing IDVT services for right-to-work and right-to-rent checks.
IDVT — Identity Document Validation Technology. Electronic identity verification for British and Irish citizens via a certified IDSP.
IR35 — Off-payroll working rules. HMRC tax rules deeming certain PSC arrangements to be employment for tax purposes.
Mandatory ground (Schedule 2 HA 1988) — A possession ground where the court must order possession if proven. Cross-reference: Cell #8 (UK Lease).
NEST — National Employment Savings Trust. Public-sector AE pension scheme; default for many small employers.
NES — National Employment Standards. (Australia term — not UK.) Note: in UK context, “national” refers to NLW/NMW.
NLW — National Living Wage. The statutory minimum hourly rate for workers aged 21+. £12.71 from 1 April 2026.
NMW — National Minimum Wage. The statutory minimum hourly rate for workers under 21 / apprentices. £10.85 (18–20), £8.00 (16–17), £8.00 (apprentice) from 1 April 2026.
P11D — Annual return of benefits in kind, filed by 6 July following the tax year end.
P45 — Statement issued when an employee leaves employment; given to next employer.
P60 — Year-end statement of pay and tax, issued by 31 May following the tax year end.
PAYE — Pay As You Earn. UK income tax withholding system administered by employers.
PIDA — Public Interest Disclosure Act 1998. Whistleblowing protection for workers; integrated into ERA 1996, Part IVA.
Probation period — Contractual concept (not statutory). Existence, conditions, duration must be in the principal statement (ERA 1996, s.1(4)(b)(ii) since 6 April 2020).
Qualifying earnings — Earnings between the lower (£6,240) and upper (£50,270) earnings limits, used to calculate pension auto-enrolment contributions.
RIDDOR — Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013.
RTI — Real-Time Information. HMRC PAYE reporting system; FPS / EPS submitted in real time.
Section 1 statement — Written statement of employment particulars under ERA 1996, s.1. Day-one right since 6 April 2020.
SMP / SPP / ShPP / SAP — Statutory family-leave pay categories (Statutory Maternity Pay / Statutory Paternity Pay / Shared Parental Pay / Statutory Adoption Pay).
SOSR — Some Other Substantial Reason. The fifth potentially fair reason for dismissal under ERA 1996, s.98.
SSP — Statutory Sick Pay. Payable to employees absent for 4+ consecutive days subject to qualifying conditions. Social Security Contributions and Benefits Act 1992.
TPR — The Pensions Regulator. AE enforcement authority. https://www.thepensionsregulator.gov.uk/en/employers
TULRCA 1992 — Trade Union and Labour Relations (Consolidation) Act 1992. Section 207A is the statutory hook for the ACAS Code 25% adjustment.
TUPE — Transfer of Undertakings (Protection of Employment) Regulations 2006. Protects employees on business transfers; preserves continuous service and most contractual terms.
Unfair dismissal — Right under ERA 1996, s.94 not to be dismissed without a fair reason and a fair procedure. Generally requires 2 years’ qualifying service (s.108); automatically unfair grounds (whistleblowing, pregnancy, etc.) have no qualifying period.
Worker — Person who undertakes to do or perform personally any work or services (ERA 1996, s.230(3)). Wider than employee; includes most casual / zero-hours / gig staff. Entitled to NMW, holiday pay, working time protection, whistleblowing protection, and (since 6 April 2020) a Section 1 statement.
WTR 1998 — Working Time Regulations 1998 (SI 1998/1833). 48-hour weekly maximum, daily/weekly rest, 5.6 weeks paid annual leave.
