0. Purpose and Philosophy — Three-Way Joy
MmowW exists for one purpose: to create a world where everyone involved achieves "Gokuraku" — a state of bliss.
- For drone operators ("Members"): Tools so intuitive that compliance becomes effortless, freeing you to focus on flying.
- For consumers and clients: Transparency and trust — you can see exactly who you are working with and their compliance credentials.
- For MmowW: A sustainable platform that grows because every participant genuinely benefits, not because anyone is locked in.
This is "San-Pou-Raku" (Three-Way Joy) — the founding principle that guides every feature we build, every price we set, and every decision we make. If a feature does not serve all three parties, we do not ship it.
MmowW Drone is operated by Sawai Gyoseishoshi Office, a licensed Gyoseishoshi (administrative scrivener) office in Japan. We are not a certification body, not a guarantor, and not a regulatory authority. We build tools. The best tools in the world.
Terms of Service
These Terms of Service ("Terms") govern your access to and use of MmowW Drone services in Australia, including the CASA-aligned compliance dashboard, free tools, and member resources (collectively, the "Service"). The Service is operated by Sawai Gyoseishoshi Office, a registered Gyoseishoshi (行政書士) firm in Japan ("MmowW", "we", "us", or "our"). By creating an account, completing a 14-day free trial, or paying for a subscription, you agree to these Terms.
1. Acceptance, Eligibility, and Account
You may use the Service only if you are a natural person at least eighteen (18) years of age, or a legal entity duly registered in Australia or a jurisdiction that recognises CASA compliance regimes. Account credentials are personal; you are responsible for every action taken through your account. Sharing one account across multiple operators is not permitted; each operator must hold their own account so that audit-trails remain attributable. We may refuse, suspend, or terminate accounts that violate these Terms, applicable law, or CASR Part 101 — Unmanned Aircraft and Rockets requirements.
2. Service Description
The Service provides CASA-aligned drone compliance support specifically for Australia operators. Core capabilities include: pilot and aircraft registration tracking aligned with CASR Part 101 — Unmanned Aircraft and Rockets; flight-log generation calibrated to CASA reporting requirements; pre-flight airspace and weather checks; an incident report builder mirroring the CASA reporting template; subscription-based access to a persistent audit-trail retained for at least 7 years; in-app diffs whenever CASR Part 101 — Unmanned Aircraft and Rockets or Developing (CASA consultation) guidance changes. Free tools are surfaced separately at /au/tools/ and are advisory only — they are not, and do not substitute, qualified legal advice.
3. Subscription, Trial, and Pricing
The Service is offered at A$8.50 / drone / month (Full Spec). New members receive a 14-day free trial that does not require a payment method during the trial period. After the trial, continued use requires an active subscription. Pricing is denominated in the local currency of Australia and may be adjusted with at least 30 days' notice; existing subscriptions remain at the current price for the balance of the prepaid term. Taxes (VAT, GST, sales tax) are added in compliance with the law of Australia. Refunds are issued pro-rata where required by consumer law.
In addition to the base subscription fee described above, we may introduce Additional Service Fees for optional premium features, enhanced visibility or promotional placement on the MmowW platform, usage-based services, or other value-added capabilities. These additional fees are separate from the base subscription rate. We reserve the right to introduce new fee categories and adjust pricing structures with at least 30 days' notice to affected members.
4. Member Obligations and Acceptable Use
You agree to: (a) keep account credentials confidential and use multi-factor authentication when offered; (b) submit accurate operator, aircraft, and flight data — false declarations may constitute an offence under CASR Part 101 — Unmanned Aircraft and Rockets; (c) maintain insurance as required by CASA and applicable law; (d) honour all third-party rights including airspace owners, landowners, and individuals' privacy. You must not: probe, scan, or stress-test the Service without prior written authorisation; introduce malware; reverse engineer except where local law expressly permits; resell the Service or expose API endpoints to non-members; or use the Service to facilitate any flight that violates CASR Part 101 — Unmanned Aircraft and Rockets or Developing (CASA consultation) guidance.
5. Member Content and Data Ownership
You retain all rights to the data you submit ("Member Content"), including operator profiles, aircraft records, and flight logs. You grant MmowW a worldwide, royalty-free licence to host, process, and display Member Content solely to provide the Service to you and to fulfil regulatory obligations. We do not sell Member Content to third parties. We may use anonymised, aggregated statistics — for example, average flight count per member in Australia — to improve the Service and to publish industry insights. 6. Compliance Authority Limits — Critical Notice
MmowW is a Japanese Gyoseishoshi (行政書士) firm. We provide compliance support, document preparation, and audit-trail technology. We are NOT a certification body, NOT a guarantor of regulatory outcomes, and NOT an authority that issues approvals on behalf of CASA. Final decisions on registration, operational authorisations, BVLOS approvals under Developing (CASA consultation), and enforcement actions rest exclusively with CASA (Civil Aviation Safety Authority). Any badge, score, or status displayed by the Service reflects MmowW's own assessment based on declared and verifiable data — it does not constitute, and must not be marketed as, an official endorsement by CASA or any government body.
7. Free Tools — Advisory Only
The free tools at /au/tools/ are provided as a courtesy to the drone community. Outputs are advisory and do not substitute (a) consultation with CASA, (b) qualified legal advice, or (c) the judgment of the pilot in command. Free tools are calibrated to CASR Part 101 — Unmanned Aircraft and Rockets as of the date displayed at the top of each tool page; we update calibration the same day CASA publishes a relevant bulletin, but real-world conditions (TFRs, NOTAMs, local NOTOs) may render advice incomplete. Use at your own risk; verify with the CASA for any flight where the operational margin is thin.
8. Service Availability and Maintenance
We target 99.5% monthly availability for the dashboard and best-effort availability for free tools. Planned maintenance is announced at least 48 hours in advance via in-app notice. Emergency maintenance — including immediate CASA regulatory updates that must be reflected before the next operational window — may be performed without prior notice. Service interruptions due to force majeure (natural disasters, internet backbone outages, government directives) are excluded from availability calculations. We do not guarantee uninterrupted access during CASA regulatory transitions; we do guarantee that updates required by CASR Part 101 — Unmanned Aircraft and Rockets are reflected within 24 hours of publication.
9. Liability, Indemnity, and Insurance
To the maximum extent permitted by the law of Australia, MmowW's aggregate liability for any claim arising out of or related to the Service is limited to the lesser of (i) the fees paid by you in the twelve (12) months preceding the claim, or (ii) £/€/$ 1,000 in local currency. We are not liable for indirect, consequential, special, or punitive damages, including lost profits or lost data resulting from operator error or CASA enforcement. You agree to indemnify and hold MmowW harmless against third-party claims arising from your use of the Service in breach of these Terms or CASR Part 101 — Unmanned Aircraft and Rockets. Members are required to maintain operational liability insurance compatible with CASA requirements; the Service does not replace that insurance.
10. Termination
You may terminate your subscription at any time from the dashboard; access continues through the end of the prepaid period and your data export is available for 30 days thereafter. We may suspend or terminate access if you (a) materially breach these Terms; (b) fail to pay; (c) use the Service in connection with conduct that violates CASR Part 101 — Unmanned Aircraft and Rockets or that exposes MmowW to regulatory sanction; or (d) request closure. Upon termination, all data is deleted within 90 days, except where retention is required for 7 years by CASA guidance, in which case the data is anonymised at the earliest lawful opportunity.
11. Governing Law, Disputes, and Changes to Terms
These Terms are governed by the law of Australia for matters within its jurisdiction and by the law of Japan for matters internal to MmowW. Disputes are first addressed through good-faith negotiation; unresolved disputes are submitted to the competent courts of Australia for member-facing claims, and to the Tokyo District Court for matters concerning MmowW's corporate operations. We may amend these Terms — material changes are announced in-app at least 30 days before effective date, and prior versions are archived at /au/terms/history/. Continued use after the effective date constitutes acceptance. If any provision is held unenforceable, the remainder remains in full effect.
