0. Purpose and Philosophy — Three-Way Joy

MmowW exists for one purpose: to create a world where everyone involved achieves "Gokuraku" — a state of bliss.

• For store operators ("Members"): Tools so intuitive that food safety management becomes effortless, freeing you to focus on what you do best — making great food.
• For consumers: Transparency and trust — you can see exactly what food safety practices a store follows and make informed choices.
• For MmowW: A sustainable platform that grows because every participant genuinely benefits, not because anyone is locked in.

This is "San-Pou-Raku" (Three-Way Joy) — the founding principle that guides every feature we build, every price we set, and every decision we make. If a feature does not serve all three parties, we do not ship it.

KitchenWeather by MmowW is operated by Sawai Gyoseishoshi Office, a licensed Gyoseishoshi (administrative scrivener) office in Japan. We are not a certification body, not a guarantor, and not a regulatory authority. We build tools. The best tools in the world.

1. Acceptance of Terms

By accessing or using KitchenWeather by MmowW (the "Service"), including the food safety library, free tools, SaaS platform, and consumer portal at mmoww.net/food/, you agree to be bound by these Terms of Service. The Service is operated by Sawai Gyoseishoshi Office ("we," "us," or "MmowW"), a licensed Gyoseishoshi (administrative scrivener) office registered in Japan.

If you do not agree to these terms, please do not use the Service.

2. Service Description

KitchenWeather by MmowW provides:

• Food Safety Library: Evidence-based HACCP best-practice articles sourced from international food safety authorities (Codex Alimentarius, FDA, FSA, EFSA, MHLW, and others). Available in 6 languages (EN, JA, DE, FR, ES, PT).
• Free Tools: CCP Decision Tree, Temperature Log, Cleaning Checklist, Quality Check, and Nutrition Info tools for food safety management.
• SaaS Platform: Store management modules for daily HACCP records, evidence management, menu allergen tracking, and safety scoring (subscription required after trial period).
• Consumer Portal: Transparency platform showing participating stores' food safety practices and scores.

3. Subscription, Trial, and Pricing

The SaaS platform offers a free to start with no setup fees. After the trial period, continued access requires a paid subscription at the published rate (approximately one fair price equivalent per store per month, varying by region).

Subscription pricing follows a step-up model based on platform growth milestones. Founding members who subscribe during Phase 1 receive a price-lock on their base subscription rate for as long as their subscription remains active and in good standing.

In addition to the base subscription, we may introduce Additional Service Fees for optional premium features, enhanced visibility or promotional placement on the MmowW platform, usage-based services, or other value-added capabilities. These fees are separate from and not covered by any founding-member price-lock on the base subscription.

We reserve the right to modify pricing structures, introduce new fee categories, adjust existing rates, or change billing frequency with at least 30 days' notice to affected members. For base subscription price changes, existing subscribers on a prepaid term will retain their current rate until the end of that term.

Cancellation is available at any time. Upon cancellation, your data remains accessible for 30 days, after which it may be archived.

4. Member Obligations

As a member (store operator), you agree to:

• Provide accurate and truthful information about your food establishment.
• Use the daily recording features honestly and not fabricate safety data.
• Maintain your own independent HACCP compliance — MmowW is a management tool, not a substitute for regulatory compliance.
• Not use the platform to deceive consumers about your food safety practices.
• Keep your account credentials secure and not share them.

5. Member Content and Data

You retain ownership of all data you input into the SaaS platform (daily records, evidence photos, menu information). By using the consumer portal feature, you grant MmowW a license to display your store's safety score, badge tier, and public profile information to consumers.

Evidence photos uploaded to the platform are stored securely and are only visible to you and, if you opt in, to consumers via the portal.

Consumer Photo Uploads

Consumers may upload photos of food purchased from member stores as part of their reviews (up to 5 photos per review). By uploading photos, consumers:

• Retain copyright — You retain full copyright ownership of all photos you upload.
• Grant a non-exclusive license — You grant MmowW a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your photos within the KitchenWeather by MmowW platform (consumer portal, store profile pages, and promotional materials).
• Food photos only — Only photos of food, beverages, menus, store interiors, and store exteriors are permitted. Photos containing identifiable faces of individuals (other than yourself) are prohibited unless you have obtained their consent.
• No third-party rights infringement — You warrant that your photos do not infringe any third party's intellectual property, privacy, or publicity rights.
• Moderation — MmowW reserves the right to remove any photo that violates these terms, contains inappropriate content, or is unrelated to the dining experience.
• Deletion rights — You may request deletion of your uploaded photos at any time by contacting info@mmoww.net. Photos will be removed within 30 days of the request.

Photos are compressed to WebP format and stored securely. MmowW does not sell, license to third parties, or use your photos for advertising outside the KitchenWeather by MmowW platform.

6. Free Tools and Library — Advisory Only

The food safety library articles and free tools are provided for educational and informational purposes only. They are based on publicly available guidance from international food safety authorities but do not constitute professional food safety advice.

Always consult your local food safety authority and qualified professionals for compliance decisions specific to your establishment.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. We reserve the right to modify, suspend, or discontinue any part of the Service — including its features, pricing structure, fee schedules, subscription tiers, and portal or promotional services — with reasonable notice.

8. Liability and Insurance

KitchenWeather by MmowW is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to food safety incidents, regulatory penalties, or business losses.

Members are responsible for maintaining their own food safety insurance and compliance with applicable laws and regulations.

9. Termination

We may terminate or suspend your account if you violate these terms, provide false safety data, or use the platform to deceive consumers. You may terminate your account at any time by contacting us at info@mmoww.net.

10. Governing Law and Disputes

These terms are governed by the laws of Japan. Any disputes shall be resolved in the courts of Tokyo, Japan. For EU/UK users, this does not affect your statutory consumer rights under local law.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via the platform and/or email. Continued use of the Service after changes constitutes acceptance of the updated terms.
