NYC Drone Penalties: Fines, Seizure and Criminal Charges

Multi-Layer Enforcement

NYC drone penalties come from multiple independent enforcement systems. This is not double jeopardy — federal, city, and state enforcement authorities operate under separate legal frameworks. A single unauthorized flight can trigger penalties from three or more enforcement bodies at the same time.

NYC Administrative Code § 10-126 Penalties

Violation of the city drone law is classified as a misdemeanor:

• Fine: Up to the statutory maximum for misdemeanors
• Imprisonment: Up to 90 days
• Drone seizure: NYPD has authority to seize the UAS as evidence
• Criminal record: A misdemeanor conviction creates a criminal record

Separate from criminal prosecution, the NYPD rules establish a graduated civil penalty schedule for operating without a permit or violating permit conditions:

• First violation: $250
• Second violation within one year: $500
• Third and subsequent within one year: $1,000

These civil penalties may run in parallel with criminal prosecution.

NYC Parks Penalties

Unauthorized drone operation in any NYC park (outside designated model aircraft fields) carries:

• Fine of up to $1,000
• Up to 90 days imprisonment
• Drone seizure by Parks Enforcement Patrol (PEP) or NYPD
• Possible parks exclusion order for repeat offenders

A parks violation is separate from a § 10-126 violation — both may be charged independently for the same flight.

FAA Federal Penalties

Federal enforcement operates independently of NYC enforcement:

• Part 107 violation: Civil penalty up to $27,500 per violation under 49 U.S.C. § 46301
• Remote ID non-compliance: Up to $27,500 per violation
• Flying unregistered: Civil up to $27,500; criminal up to $250,000 fine + 3 years imprisonment
• Unauthorized controlled airspace flight: Up to $27,500 per violation
• Interference with manned aircraft: Up to $250,000 fine + 3 years imprisonment under 18 U.S.C. § 32
• Certificate action: The FAA may suspend or revoke your Part 107 Remote Pilot Certificate

New York State Criminal Charges

When drone conduct goes beyond a regulatory violation and involves danger to persons or property damage, state criminal charges may apply:

• Reckless Endangerment 2nd degree (Penal Law § 120.20): Class A misdemeanor — up to 1 year
• Reckless Endangerment 1st degree (Penal Law § 120.25): Class D felony — up to 7 years imprisonment
• Criminal Mischief (Penal Law §§ 145.00–145.12): Misdemeanor to Class B felony depending on damage value
• Assault 3rd degree (Penal Law § 120.00): Class A misdemeanor if drone causes physical injury
• Assault 2nd degree (Penal Law § 120.05): Class D felony if drone causes serious physical injury recklessly
• Unlawful Surveillance (Penal Law §§ 250.45–250.50): Class E or D felony for recording persons without consent in private settings

Drone Seizure and Property

Both NYPD and Parks Enforcement Patrol (PEP) have authority to seize drone equipment as evidence. Seized property enters the NYC property clerk system. Return of equipment after adjudication depends on case disposition. In some cases, forfeiture proceedings may apply.

Worst-Case Scenario

Consider an unauthorized commercial flight over Central Park that narrowly misses a helicopter:

• NYPD: § 10-126 misdemeanor (up to 90 days) + civil fine ($250–$1,000)
• Parks: 1 RCNY § 1-05(r)(2) violation (up to $1,000 + 90 days)
• FAA: Civil penalty (up to $27,500 per violation) + certificate revocation
• State: Reckless Endangerment 1st degree (up to 7 years)
• Federal: Interference with manned aircraft (up to $250,000 + 3 years)
• Equipment: Drone seized as evidence
