Why Most SMEs Are Over-Worrying

The EU AI Act is primarily aimed at AI developers and deployers of high-risk systems. If your small business uses AI tools built by others (ChatGPT, Microsoft Copilot, Google Gemini, etc.), you are a 'deployer' with limited obligations. The heavy compliance requirements — conformity assessments, technical documentation, quality management systems — fall on the AI providers.

Your main obligations as an SME deployer are: (1) ensure AI literacy among staff (Article 4, already in force), (2) use high-risk AI systems according to instructions (Article 26), and (3) monitor high-risk AI systems for risks (Article 26). If you do not use any high-risk AI, obligation (1) is essentially your only requirement.

The 3-Step SME Compliance Plan

Step 1: AI Inventory — List every AI tool your business uses. Include who uses it, what for, and what data it processes. This takes 30 minutes for a typical SME.

Step 2: Risk Classification — Check each tool against the Annex III high-risk categories. If none are high-risk (most SME tools are not), document this finding and proceed to Step 3.

Step 3: AI Literacy Documentation — Create a one-page AI use policy for your team. Cover: acceptable use, data handling, output verification, and incident reporting. Brief your team. File the policy. You are compliant.
